1. Acceptance of These Terms

These Terms and Conditions ("Terms") govern your use of focus3d.net and any related pages, content, downloads, memberships and products (together, the "Website"). The Website is owned and operated by Focus3D™ ("FOCUS 3D," "we," "us" or "our").

By accessing or using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website. You must be at least 18 years old to create an account, purchase products or join a membership.


2. Educational Content Only

All content on the Website, including articles, podcasts, videos, tools, templates, worksheets, books and downloads, is provided for general educational and informational purposes only. It reflects the experience and opinions of Dave Brooks and FOCUS 3D.

Nothing on the Website is financial, investment, tax, legal, regulatory or compliance advice, and no professional relationship is created by your use of it. FOCUS 3D is not acting as your financial advisor, attorney or compliance officer.

Financial services professionals are responsible for following the rules of their firm, broker-dealer, regulators and any applicable licensing bodies. Before using any FOCUS 3D material with clients, prospects or your team, review it with your firm's compliance department where required.

Results vary. Any examples, stories or outcomes described on the Website are not a guarantee or prediction of the results you will achieve.


3. Using the Website

You agree to use the Website only for lawful purposes. You will not:

  • Copy, scrape, resell or redistribute Website content except as these Terms allow
  • Share your login or membership access with anyone else
  • Attempt to gain unauthorized access to the Website, its servers or other users' accounts
  • Upload viruses, malicious code or anything that interferes with the Website's operation
  • Use the Website to send spam or unsolicited messages
  • Misrepresent your identity or affiliation.

We may suspend or end your access at any time if we believe you have violated these Terms.


4. Free Resources and Downloads

FOCUS 3D offers some tools and templates free of charge, such as the Annual Training Plan. When you request a free resource, you may be asked for your name and email address, and you agree that we may send you the resource and related emails as described in Section 9.

Free resources are licensed to you for your personal use and for internal use within your own office, team or agency. You may not sell them, post them publicly, remove the FOCUS 3D branding or copyright notice, or redistribute them outside your organization without our written permission.


5. Intellectual Property

The Website and everything on it, including text, graphics, logos, the FOCUS 3D name and emblem, 3 Diamond Decades, podcast episodes, videos, tools, templates and downloads, are owned by FOCUS 3D or its licensors and are protected by copyright, trademark and other intellectual property laws.

Except for the limited licenses described in these Terms, no rights are granted to you. You may share links to public pages of the Website, and you may quote brief excerpts with clear attribution to FOCUS 3D and Dave Brooks.


6. Accounts and Brooks Vault Membership

Some content, including Brooks Vault, requires an account. You agree to provide accurate information, keep your login details secure and tell us promptly about any unauthorized use of your account. You are responsible for activity under your account.

Individual memberships are for one person and may not be shared. Office or District memberships cover the number of users purchased; the purchaser is responsible for managing who has access.

Billing and renewal. Paid memberships are billed in advance on the schedule shown at checkout and renew automatically until cancelled. By joining, you authorize us and our payment processor to charge your payment method for each renewal.

Cancellation. You may cancel at any time from your account or by contacting us. Cancellation stops future renewals; you keep access until the end of the current billing period. REFUND POLICY: Membership fees are non-refundable except where required by law.

Changes. We may change membership pricing or content. Price changes apply at your next renewal, and we will notify you in advance.


7. Shop Purchases

Products in the FOCUS 3D Shop are digital unless stated otherwise. Prices are listed in U.S. dollars and may change at any time before purchase. Payments are handled by third-party processors, and we do not store your full payment card details.

Digital products are licensed, not sold, under the same terms as Section 4: for your own use and internal use within your office or team. Because digital products are delivered immediately, all sales are final. If a file is damaged or does not download, contact us and we will make it right.


8. Podcast, Guests and Testimonials

Podcast guests share their own views, which may not reflect the views of FOCUS 3D. Testimonials and success stories reflect individual experiences and are not typical or guaranteed results.

9. Email Communications

When you request a resource, create an account, make a purchase or contact us, you agree that we may email you about your request and about FOCUS 3D content, resources and offers. You can unsubscribe from marketing emails at any time using the link in any email. We will still send messages related to your account or purchases.

 

10. Your Submissions

If you send us comments, questions, ideas or other material through forms, email or social media, you confirm you have the right to share it and that it does not violate anyone's rights. You give us permission to use non-confidential feedback to improve our content and services without payment to you. Please do not send confidential client information.

 

The Website may link to or use third-party websites and services, such as podcast platforms, YouTube, payment processors and booksellers. We do not control and are not responsible for their content, policies or practices. Your use of them is governed by their own terms.

 

12. Disclaimer of Warranties

The Website and all content, products and memberships are provided "as is" and "as available." To the fullest extent permitted by law, FOCUS 3D disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Website will be uninterrupted, error-free or free of harmful components.

 

13. Limitation of Liability

To the fullest extent permitted by law, FOCUS 3D, Dave Brooks and their affiliates, contractors and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, clients or data, arising from your use of the Website or its content.

Our total liability for any claim related to the Website will not exceed the amount you paid to FOCUS 3D in the 12 months before the claim, or $100 if you paid nothing.

 

14. Indemnification

You agree to indemnify and hold harmless FOCUS 3D, Dave Brooks and their affiliates from any claims, losses or expenses, including reasonable attorneys' fees, arising from your use of the Website, your violation of these Terms, or your use of FOCUS 3D material with your clients or team.

 

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Okaloosa County, Florida, and you consent to their jurisdiction. If any part of these Terms is found unenforceable, the rest remains in effect.

 

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continuing to use the Website after changes are posted means you accept the updated Terms.
